Terms of Use

The short version

These Terms of Use ("Terms") are an agreement between you and NeuroTrocity ("we", "us", "our") governing your use of the DisPoint app and the pages under neurotrocity.com/dispoint (together, the "Service"). By downloading, installing or using DisPoint, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use DisPoint

You must be at least 16 years old, and able to form a binding contract, to use DisPoint. DisPoint is designed for use in Australia; features, deals and loyalty programs assume an Australian context.

2. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use DisPoint on Apple devices you own or control, for your own personal, non-commercial use, subject to these Terms and the End User License Agreement (see our EULA).

3. What DisPoint is — and isn't

DisPoint is a personal organiser for discount codes and points deals, plus a small curated catalogue of publicly available Australian promotions gathered from public sources. DisPoint does not sell any product, does not process any retail purchase, and is not a party to any transaction between you and a retailer or loyalty program.

4. Deals, codes and availability — no guarantee

Deals change constantly. We do not warrant that any code, offer, discount, price, multiplier, expiry date, or points promotion shown in DisPoint — whether you entered it yourself or it appears in the curated catalogue — is accurate, current, valid, or available. Offers may expire, sell out, contain errors, be region- or account-limited, or be withdrawn by the retailer or program at any time. Always confirm the offer and its terms directly with the retailer or loyalty program before relying on it. Your use of any third-party offer is at your own risk and subject to that third party's terms.

5. Points estimates are estimates

DisPoint's "Point Potential" calculator and any points figures are estimates only, generated from the information you enter and simple stated assumptions (for example, "$1 = 1 point," multiplied by a deal's rate, and fixed conversion ratios shown in the app). They are not a guarantee of the points you will actually earn or their value, and loyalty programs may change their earn rates, conversion ratios, and rules at any time. Nothing in DisPoint is financial, investment, or tax advice.

6. No affiliation with third parties

Retailer and loyalty-program names, logos and trade marks shown in DisPoint belong to their respective owners and are used only to identify those businesses. DisPoint and NeuroTrocity are independent and not affiliated with, sponsored by, or endorsed by any of them.

7. Acceptable use

You agree not to misuse the Service — including not to reverse engineer the app except as permitted by law, not to use it to break any retailer's or program's terms, not to interfere with its operation or security, and not to use it for any unlawful purpose.

8. Ads and in-app purchases

The free version of DisPoint is supported by ads (see our Privacy Policy). You may remove ads and unlock additional features by purchasing "DisPoint Pro," a one-time in-app purchase processed by Apple. All purchases are subject to the App Store's terms and Apple's refund policies; we don't process payments and can't issue App Store refunds directly.

9. Your content

The deals, notes and screenshots you save are yours. They stay on your device and your own iCloud; we don't claim ownership of them and don't access them. You are responsible for the information you enter and for having the right to save any screenshot you capture.

10. Intellectual property

DisPoint, its design, the "departure board" visual identity, and its original content are owned by NeuroTrocity and protected by law. These Terms don't transfer any of our intellectual property to you.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy. We don't warrant that the Service will be uninterrupted, error-free, or that any deal will save you money.

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability can be limited, it is limited (at our option) to re-supplying the Service or paying the cost of doing so.

12. Limitation of liability

To the maximum extent permitted by law, NeuroTrocity will not be liable for any indirect, incidental, special or consequential loss, or for any lost savings, missed deals, expired codes, or points not earned, arising from your use of — or inability to use — the Service.

13. Changes

We may update the Service and these Terms from time to time. We'll change the "Last updated" date when we do; material changes take effect when posted. Continuing to use DisPoint means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
