End User License Agreement

The short version

This End User License Agreement ("EULA") is between you and NeuroTrocity ("we", "us", "our"), the provider of the DisPoint application ("the Licensed Application"). It governs your use of the Licensed Application obtained through Apple's App Store.

1. Apple's standard EULA applies

Except where varied below, your use of DisPoint is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), published by Apple at apple.com/legal/internet-services/itunes/dev/stdeula/. By downloading or using DisPoint you agree to the Standard EULA as supplemented by this document. If there is a conflict between the two on a DisPoint-specific matter, this document controls; otherwise the Standard EULA controls.

2. Licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to install and use DisPoint on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules, solely for your personal, non-commercial use. DisPoint is licensed, not sold, to you.

3. Scope and restrictions

You may not rent, lease, lend, sell, redistribute, sublicense, or make the Licensed Application available over a network where it could be used by multiple devices at once; and you may not copy, decompile, reverse-engineer, disassemble, attempt to derive the source code of, or create derivative works of DisPoint, except to the extent that such restriction is prohibited by applicable law.

4. In-app purchases

DisPoint offers "DisPoint Pro," a one-time non-consumable in-app purchase that removes ads and unlocks additional features. In-app purchases are sold and processed by Apple, are subject to Apple's terms and refund policies, and are made available under this licence once purchased.

5. Consent to data use

You agree that we and our service providers may collect and use technical data as described in our Privacy Policy, including the limited, non-personalised advertising data handled by Google AdMob. DisPoint stores your personal library on your own device and iCloud; we do not collect it.

6. No warranty

To the maximum extent permitted by applicable law, DisPoint is provided "as is" and "as available," without warranty of any kind, and your use is at your own risk. Apple has no obligation to furnish any maintenance or support for DisPoint. Nothing in this EULA excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded (see our Terms of Use).

7. Maintenance and support

NeuroTrocity is solely responsible for providing any maintenance and support for DisPoint, as required by law. You can reach us at dispoint@neurotrocity.com. Apple has no obligation whatsoever to provide any maintenance and support services for DisPoint.

8. Product claims

NeuroTrocity, not Apple, is responsible for addressing any claims relating to DisPoint, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection or similar legislation, to the extent not excluded by law.

9. Intellectual property

In the event of any third-party claim that DisPoint or your possession and use of it infringes that third party's intellectual property rights, NeuroTrocity — not Apple — is solely responsible for the investigation, defence, settlement and discharge of any such claim, to the extent required by law.

10. Third-party terms

You agree to comply with applicable third-party terms when using DisPoint (for example, the terms of the App Store and of retailers or loyalty programs whose offers you choose to use).

11. Apple as third-party beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

12. Governing law

This EULA is governed by the laws of Queensland, Australia, except to the extent Apple's Standard EULA specifies otherwise for matters within its scope.
